Terms and Conditions

A note before the formal part

These Terms exist so we both know what to expect when you use my websites and services. I have kept them as plain as I can while still being clear. If anything here is confusing, email me at louise@louiseneil.com and I will happily explain.

These Terms cover your use of the services provided by Pivoting Point Coaching and Consulting, which operates as The Menopause Doula and Menopause At Work, including our websites louiseneil.com, themenopausedoula.ca, and menopauseatwork.ca. Throughout, "we," "us," and "our" refer to Pivoting Point Coaching and Consulting.

Agreeing to These Terms

By using our services, you agree to these Terms and to any specific guidelines posted alongside a particular service. If you do not agree with them, please do not use the service.

What Belongs to Us

Apart from content that is yours, the material on our websites and in our services belongs to us or to the people who license it to us. You are welcome to view and use it for your own personal, non-commercial use. Please do not copy, sell, republish, or otherwise reuse it without our written permission.

Please Don't

To keep our services working well and fairly for everyone, please do not:

• Republish our material in any medium
• Sell, sublicense, or otherwise commercialize our material
• Publicly perform or display our material
• Use the service in a way that damages it, or that gets in the way of other people using it
• Use the service in a way that breaks the law, or that causes harm to any person or business
• Scrape, mine, harvest, or extract data from the service
• Use the service for advertising or marketing without our written consent

Content You Share

If you post or share content on our services, whether that is text, images, audio, video, or anything else, it stays yours. By sharing it, you give us a non-exclusive, worldwide, royalty-free, sublicensable licence that does not expire, allowing us to use, reproduce, adapt, publish, translate, and distribute it in connection with our services and our marketing. In plain terms: if you share something with us, we can keep using it in our work.

Please only share content that is yours to share and that does not infringe anyone else's rights. We may remove content from our services at any time if we need to.

What We Can and Can't Promise

I want to be straightforward here. Our services and materials are offered as they are. We put real care into them, but we cannot promise that everything will be perfect, uninterrupted, or right for every particular purpose, and we do not make warranties, whether stated outright or implied, about our services or their materials.

Paying for Services

For some services, you will need to give payment details, such as a card number and billing address. When you do, you confirm that the information is accurate and that you are allowed to use that payment method. Please keep your details current, for example if your billing address or card expiry date changes.

We use trusted third-party payment services to process and, where needed, store your payment information. By submitting your details, you agree to that handling. We take reasonable care to keep your information secure and in line with our Privacy Policy. Each payment processor has its own terms, so it is worth reviewing those before you buy.

Refunds and Cancellations

I want this to be clear and fair, so here is how refunds and cancellations work, depending on what you have booked or bought. If your situation does not fit neatly into one of these, email me at louise@louiseneil.com and we will sort it out together.

One-to-one coaching.  Coaching packages and sessions are paid for in advance. If you need to reschedule a session, please give at least 24 hours' notice and we will find a new time at no charge. A session cancelled or missed with less than 24 hours' notice counts as used. Because coaching time is booked and held just for you, package fees are non-refundable once we have begun the work. If something significant comes up in your life, reach out and we will talk it through.

Group programs, workshops, and peer circles. For live group offerings, you can cancel for a full refund up to 14 days before the start date. Within 14 days of the start, fees are non-refundable, but you are welcome to transfer your spot to a future round or send someone in your place, as long as you let us know beforehand.

Memberships.  You can cancel your membership at any time, and your access continues until the end of the period you have already paid for. We do not offer partial refunds for a period already underway.

Digital and self-paced products.  Because these are delivered to you right away, they are non-refundable once you have accessed or downloaded them.

Work with organizations.  Custom and corporate engagements are covered by the separate agreement we sign for that work. The terms in that agreement apply, rather than the ones here.

To request a refund or cancel something, just email louise@louiseneil.com and tell me what you booked. I read those myself.

Where Our Responsibility Ends

To the extent the law allows, we are not responsible for losses arising out of or connected to your use of our services, including indirect, consequential, or special losses. This applies to us and to anyone working with us.

Covering Us for Your Actions

If your use of our services, or your breaking of these Terms, leads to a claim, cost, or legal action against us, you agree to cover us for it, to the fullest extent the law allows.

If Part of This Doesn't Hold Up

If any part of these Terms turns out to be invalid under the law, that part can be removed and the rest of the Terms still apply.

Updates to These Terms

We may update these Terms from time to time. When we do, the current version applies, so it is worth checking back now and then to stay familiar with them.

Passing On These Terms

We may transfer our rights and responsibilities under these Terms to someone else, for example if the business changes hands. You cannot transfer yours without our agreement.

The Whole Agreement

These Terms, along with any notices and disclaimers on our services, make up the entire agreement between us about your use of the services, and they replace anything discussed beforehand.

Governing Law and Where Disputes Are Handled

These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply there. Any disputes will be handled by the courts of Manitoba.
